Well think about it, they have the loophole that as long as you give you real name you can be annoying so that no one can say its against the first amendment, much like they have the law saying the government can't read emails without a warrant while they're in transfer, but the NSA scans every email that goes through the world wide web, they just wait until after its been transferred.
No one bothered to stand up against this loophole and get it changed, but it's caused a lot of problems, and this one causes pure oppression, but will people still even care enough? The water is turning up a few degress and nobody seems to notice.
It should be able to be considered under the First Amendment. Anonymous writers might be annoying to someone that reads it, but is it illegal for that person to remain anonymous? No. The internet shouldn't be any different.
